SparkYa User Agreement

1. Acceptance of Terms

By downloading, creating an account, accessing, or using SparkYa, you agree to this User Agreement. If you do not agree, please do not use SparkYa.

2. About SparkYa

SparkYa is a relationship companion app that helps users record meaningful moments, reflect on moods, manage profile information, and use private message or media features made available in the app. SparkYa is intended for personal, lawful, and non-commercial use unless we agree otherwise in writing.

3. Accounts and Security

You may sign in using supported methods such as Apple sign-in or email. You are responsible for keeping your device, credentials, and account information secure. Please provide accurate information and keep it up to date where the app asks you to maintain a profile.

4. Your Content

You are responsible for the moments, photos, chat messages, profile details, mood entries, comments, and other content you create or provide in SparkYa. You represent that you have the rights and permissions needed to submit that content and that your content will not violate the rights, privacy, or safety of others.

You retain ownership of content you provide. You grant SparkYa the limited permission needed to operate, display, store, process, and support the app features you choose to use.

5. Acceptable Use

• Do not misuse, disrupt, reverse engineer, or attempt unauthorized access to SparkYa.
• Do not use SparkYa to violate laws, rights, privacy, or security of others.
• Do not upload, create, or share unlawful, abusive, deceptive, infringing, or harmful content.
• Do not impersonate others or submit information you are not authorized to use.
• Keep your device, account, and app data secure.

6. Personal Reflection Disclaimer

SparkYa is for personal journaling and reflection. It does not provide diagnosis, therapy, counseling, medical advice, legal advice, or other professional services. Any app content is for general personal reflection only.

7. Intellectual Property

SparkYa, including its design, software, branding, and related materials, is owned by SparkYa or its licensors and is protected by applicable intellectual property laws. This Agreement does not transfer ownership of SparkYa to you.

8. Third-Party Services

SparkYa may use third-party services for functions such as sign-in, hosting, analytics, crash reporting, media handling, push notifications, or customer support. Third-party services may have their own terms and privacy policies. We are not responsible for third-party content, policies, or practices.

9. Updates and Changes

We may update, modify, suspend, or discontinue SparkYa or parts of SparkYa at any time. We may also update this Agreement by posting the latest version on this page.

10. Disclaimer

SparkYa is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, SparkYa and its team will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use SparkYa.

12. Termination and Account Deletion

We may suspend or terminate access to SparkYa if you violate this Agreement or if continued access would create legal, security, or operational risk.

You may stop using SparkYa at any time. Where available, you may delete your account in the app. You may also contact us to request account or data deletion, subject to verification and any retention required by law, security, or legitimate business needs.
